ARTICLE 1- (1) The purpose of this Regulation is to enforce the decision taken upon the completion of the anti-dumping investigation conducted by the Ministry of Trade, General Directorate of Imports, regarding the claims that the anti-dumping measures implemented for the “connection parts of dental prostheses” classified under customs tariff statistic position 9021.29.00.00.00, originating from the Republic of Korea, were rendered ineffective by the reduction of export prices. This measure was initially introduced by the Regulation on Preventing Unfair Competition in Imports (Regulation No: 2022/12), published in the Official Gazette No. 31809 on 14/4/2022. The investigation, opened again under the Regulation on Preventing Unfair Competition in Imports (Regulation No: 2024/7) published in the Official Gazette No. 32462 on 16/2/2024, concerns the companies Megagen Implant Co. Ltd. and Dio Corporation located in the country subject to the measure.
Legal Basis
ARTICLE 2- (1) This Regulation is prepared based on the Law on Preventing Unfair Competition in Imports No. 3577, dated 14/6/1989, the Decree No. 99/13482 on Preventing Unfair Competition in Imports, enacted on 20/10/1999, and the Regulation on Preventing Unfair Competition in Imports, published in the Official Gazette No. 23861 on 30/10/1999.
Definitions
ARTICLE 3- (1) In this Regulation, the following terms are defined as:
a) Ministry: The Ministry of Trade,
b) CIF: Delivery including costs, insurance, and freight,
c) General Directorate: The General Directorate of Imports, Ministry of Trade,
ç) Customs Tariff Statistic Position (GTIP): Customs tariff statistic position,
d) Board: The Unfair Competition Evaluation Board in Imports,
e) TGTC: The Turkish Customs Tariff Schedule divided into Statistical Positions,
f) Regulation: The Regulation on Preventing Unfair Competition in Imports, published in the Official Gazette No. 23861 on 30/10/1999.
Decision
ARTICLE 4- (1) As a result of the conducted investigation, it was determined that the existing anti-dumping measures were rendered ineffective by the companies Megagen Implant Co. Ltd. and Dio Corporation by reducing export prices. Additionally, it was found that Evidence Implant Inc. had undermined the measures by benefiting from the anti-dumping rate applied to Megagen Implant Co. Ltd., rather than the rate applicable to itself. The Informational Report containing the findings and conclusions from the investigation conducted by the Ministry of Trade, General Directorate of Imports, is included in the annex.
(2) In this context, after evaluating the findings from the investigation, the decision of the Board, and the approval of the Minister of Trade, it has been decided to amend the anti-dumping measure enforced under the Regulation on Preventing Unfair Competition in Imports (Regulation No: 2022/12) as shown in the table below.
Application
ARTICLE 5- (1) Customs authorities, in the importation of goods under the customs tariff statistic position (GTIP) and goods description mentioned in Article 4, will collect definitive anti-dumping measures at the rates indicated in the corresponding column, subject to the provisions of other legislation.
(2) The explanations in the Informational Report regarding the subject product and similar products are general, and the application is based on the GTIP in the current Turkish Customs Tariff Schedule (TGTC) and the goods description in the table in Article 4.
(3) Changes made in the tariff position and/or description of the product subject to the measure in the current TGTC do not prevent the implementation of the provisions of this Regulation.
(4) For imports covered by the first paragraph, customs authorities will require a producer certificate for each firm, including those subject to the “Others” measure as per the Regulation on Preventing Unfair Competition in Imports (Regulation No: 2002/1), published in the Official Gazette No. 24669 on 12/2/2002.
(5) The measures under this Regulation will expire five years after the effective date of the Regulation on Preventing Unfair Competition in Imports (Regulation No: 2022/12).
(6) If a final review investigation is initiated before the expiration of the measures under this Regulation in accordance with Article 35 of the Regulation, the measures will remain in force until the investigation is concluded.
Effective Date
ARTICLE 6- (1) This Regulation shall come into force on the date of its publication.
Enforcement
ARTICLE 7- (1) The Minister of Trade shall enforce the provisions of this Regulation.
